Son La Union comments on the draft Laws

Son La – May 16 and 17, 2022, the Union of Science and Technology Associations of Son La province (Son La Union) held a consultation workshop on the amended Law on Prevention and Control of Domestic Violence and the Law on Medical Examination and Treatment.

Madam Pham Thi Ha - Secretary of the Party, President of Son La Union chaired the workshop. Attending the workshop were Mr. Kha Manh Sam - Standing Deputy Head of the Provincial Committee for Mass Mobilization; Mr. Nguyen Tien Viet – Deputy Head of the Provincial Party Committee's Propaganda Department; leaders of the Provincial National Assembly Delegation, Department of Science and Technology, Department of Health, Department of Culture, Sports and Tourism, Provincial Labor Confederation; Provincial Women's Union, Son La Provincial Youth Union, Son La Union Standing Committee and representatives of Son La Union member associations.

The workshop aims at bringing expertise of intellectuals and member associations to comment for the development of the Law. Delegates strongly agreed that the need of amendment of the Law on Domestic Violence Prevention and Control and the Law on Medical Examination and Treatment in order to specify the Party's guidelines, policies and laws of the State; overcome shortcomings and inadequacies of the current Law and be in line with international practices.

15 years into implementation of the Law on Domestic Violence Prevention and Control (in 2007), it has created a positive change in awareness in domestic violence prevention and control, facilitating the protection of victims of domestic violence, and promoting gender equality in the family. Party committees and government leaders at all levels have paid much attention to the implementation of prevention and combating of domestic violence. A number of initiatives and models of domestic violence prevention and control have been carried out in many provinces, proving effective results as well as increased social resources in domestic violence prevention and control. However, despite the achievements, domestic violence is still a pervasive problem in Vietnam. In fact, many cases of domestic violence with serious physical injury, complicated development, sophisticated, unpredictable and unmanageable by current legal regulations, have been reported.

Provisions of the 2007 Law on Domestic Violence Prevention and Control are not really appropriate with the current situation of domestic violence. The draft Law on Domestic Violence Prevention and Control (amended) includes 6 chapters and 62 articles, of which 42 articles are amended and supplemented in the current Law; 17 articles are completely new; 3 articles removed and 16 articles increased as compared with the current Law.

The Law on Medical Examination and Treatment was issued in 2009. The formulation of the Law aims to timely and fully institutionalize the guidelines of the Party and State on strengthening the protection, care and improvement people's health. With perspective of considering the patient as a key actor in all activities and services of providing medical examination and treatment through improving accessibility to high quality medical examination and treatment services, the Law on Medical Examination and Treatment (amended) includes 12 chapters, 106 articles; 3 chapters and 15 articles added.

The workshop recorded more than 60 comments and opinions from participants related to legal framework, practical basis, document format, dossier and law-making techniques, title of the draft Law, scope of regulation, addition and explanation of terms, amendments and supplements to a number of articles of the draft Law and additional proposals.

Son La Union collected comments and opinions from the workshop and made a synthesis report to submit to the Provincial National Assembly Delegation.
